Apparently the New Jersey supreme court has ruled that homosexuals have the same rights to marry as heterosexuals. Yea! I now think the Va constitutional amendment will pass. Boo!
Everyone who is a Va Voter: Vote No on the marriage amendment!
I've always been pretty sure it was going to pass, quite frankly. Not that I'm not going to vote against it and encourage everyone else to, of course. Can we take Arlington, Fairfax, and maybe part of Loudoun and secede from the rest of the state? Pleeeeeeaaaase?? Er, we'd need to give back Herndon while we're at it; they and Manassas can form their own little "no immigrants allowed" enclave somewhere else.
Well, it was a lot closer to even than I had any hope for, and even some republican lawyers were saying "err, this isn't a good idea", and with there being no recent action about "activist judges" I thought that there was a decent chance the amendment would fail. Now I expect all the conservative anti-gays will have an energized base.

I've been wishing for this for a while. There are times I hang my head when I say I am from Virginia. If this ammendment passes I am sure I will do so more.

They are leaving it up to the legislature to determined whether they can get married or whether they will create a "Civil Union" status.

Personally, I think that approach is better. It recognizes the inequity while avoiding the "Marriage is between a man and woman!" issue.
I think they'll end up defining some "Jersey Only" Civil Union statute that includes a Time-Bomb clause that it dissolves if the partners aren't residents of Jersey. That would pre-empt people from getting married in Jersey and then suing in a different state to have it recognized there.
